Philadelphia Spousal Abuse Attorneys
A Protection from Abuse Order protects the victims from physical abuse, verbal abuse, stalking, and even the threat of physical abuse.
Under Pennsylvania law, a party must only prove that they are in fear of imminent bodily injury, that they have been a victim of physical harm, or that they are being stalked or harassed. New Jersey offers similar protection to victims of abuse, in the form of an order of protection. However, New Jersey does not require a fear of "imminent" bodily injury. Rather, under New Jersey law, to demonstrate potential future violence against the victim, an abuser must commit of one of 13 underlying crimes, including:
- Homicide
- Assault
- Sexual assault
- Criminal sexual contact
- Lewdness
- Kidnapping
- Criminal restraint
- False imprisonment
- Stalking
- Terroristic threats
- Harassment
- Burglary
- Criminal mischief
- Criminal trespass
We understand how frightening this process can be. Our compassionate Pennsylvania domestic violence attorneys will help our clients understand the potential outcomes and any other options. Our clients know and trust that we will work hard for them.
